The ninth circuit court has maintained a prohibition on sending state troops in Portland, Oregon, following a recent legal decision.

Appeals Court Concurs to Rehear Case

The federal appeals court decided on Tuesday that it would reexamine the legal dispute concerning the president’s authority with an expanded group of eleven justices. The judicial body also overturned a previous decision from a smaller judicial group that had supported the administration.

Legal Saga Over Military Presence

This order represents the latest development in a protracted legal battle over whether the former president has the authority and justification to deploy national guard forces in Portland. Approximately two hundred troops have been in limbo since late September when the mobilization attempt was initiated in due to months of protests.

Differing Viewpoints

The administration has argued that government employees at the immigration center in the southern part of the city were under attack, while city and state officials assert that municipal police have command of the circumstances.

In defiance of characterizations of the city as a conflict zone, residents have been posting videos of lush hiking trails and a thriving food scene, and planning activities such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a US district judge in the city issued two temporary restraining orders this period – one blocking the federal control of the state troops, and another stopping the use of any national guard troops in Oregon, after attempts to evade the first order by calling up out-of-state forces.

On the previous day, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction remained in place, preventing the actual deployment of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard by the full court – with both rulings under review simultaneously – by a group of eleven justices.

“This ruling shows that the truth matters and that the judicial system are working to hold this administration accountable. The constitution limits the executive authority, and local populations cannot be treated as a training ground for expansive government power,” stated the legal representative in a statement.

“The judicial body is sending a definite signal: the president cannot send the armed forces into US cities unnecessarily. We will continue protecting Oregon’s laws, principles, and sovereignty as this case progresses and our legal battle continues in the courts.”
